On December 27, 2023, the U.S. Citizenship and Immigration Services (USCIS) announced a final rule to adjust the premium processing fees for certain immigration forms due to inflation. This adjustment will take effect on Monday, February 26, 2024. The premium processing fees for eligible forms and categories will increase to reflect inflation measured by the Consumer Price Index for All Urban Consumers.
The table of adjusted fees is as follows:
Form | Previous Fee | New Fee |
Form I-129 | $1,500 (H-2B or R-1 nonimmigrant status), $2,500 (All other available Form I-129 classifications) | $1,685 (H-2B or R-1 nonimmigrant status), $2,805 (All other available Form I-129 classifications) |
Form I-140 | $2,500 (Employment-based (EB) classifications) | $2,805 (Employment-based (EB) classifications) |
Form I-539 | $1,750 (Form I-539 classifications) | $1,965 (Form I-539 classifications) |
Form I-765 | $1,500 (Certain F-1 students with specific categories) | $1,685 (Certain F-1 students with specific categories) |
It’s important to note that premium processing can only be requested for benefits that USCIS has announced availability on its website. Additionally, if USCIS receives a Form I-907 postmarked on or after February 26, 2024, with the incorrect filing fee, it will reject the form and return the filing fee. For filings sent by commercial courier, the postmark date is the date reflected on the courier receipt.
