What is a Multinational Executive or Manager,(EB-1)?
Considered a first-preference employment-based immigration category, a foreign national who will be in a multinational executive or manager capacity in the U.S. may be eligible.
REQUIREMENTS
To be eligible, a Foreign national must have been employed outside the U.S. for at least one year within the last three years prior to the petition being filed on their behalf. The Foreign National must also have been in a managerial position for at least one year in the position held abroad. If the foreign national is already working for the U.S. employer (petitioner), the petitioner must have been doing business for one year and have a qualifying relationship with the foreign national’s previous employer abroad.
PROCESS
A beneficiary’s U.S. employer must file Form I-140, Petition for Alien Worker, with USCIS to show their ability to pay the offered salary in addition to the above mentioned requirements. A labor certification with the Department of Labor is not required for this category.
