When a USCIS Deadline Falls on a Weekend

USCIS has updated the USCIS Policy Manual to address how to approach the “last day” to file a benefit request or response when the deadline falls on a Saturday, Sunday, or federal holiday. Luckily, USCIS will consider paper filings timely if submitted by the end of the next business day. It should be noted that the receipt date will be when the physical filing is received, but USCIS will consider it timely filed. 

This update in policy does not apply to any electronic filings as electronic submissions are considered received immediately upon submission. This policy is also not being applied retroactively. 

In immigration law, deadlines are everything. A missed deadline could mean an abandonment of application or denial of entry. It’s always important to stay on top of important dates for a particular foreign national’s case.
