The U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated caps for H-1B visas for fiscal year (FY) 2024. The regular cap of 65,000 and the master’s cap of 20,000 for U.S. advanced degree exemptions have both been met. Non-selection notices will be sent to registrants through their online accounts in the coming days. Registrations not selected will display a status of “Not Selected,” indicating ineligibility to file an H-1B cap petition based on the current registration.
However, the USCIS will continue to accept and process petitions that are exempt from the cap. This includes petitions for current H-1B workers seeking:
– Extension of stay in the United States
– Change in terms of employment
– Employer change
– Concurrent employment in additional H-1B positions
